The package of tax credits, bond financing, loan guarantees, and direct federal investment dollars makes development and investment in these areas of paramount interest to developers and institutional investors seeking the next level of financial success and risk management.  The menu of incentives you need to be aware of include:

  • Bonus Depreciation Credits.  Put a business asset in service before 01JAN10 and a special 50% bonus depreciation credit may be taken by the taxpayer for certain counties in Mississippi and select parishes in Louisiana.  this applies to both real property improvements and Section 179 amortized assets.  This makes equity syndications for developers with otherwise marginal financial resources more likely to be completed without the developer having to, "give away the store," in order to get the deal done.  The clock is definitely ticking on this program, so if you have a project for the GO Zone area and haven't contacted us to discuss the structured finance alternatives out there that exist right now, then shame on you.  There's a half off sale and you better get ready to go shopping.  Like every sale, this one is for a limited time only.

  • Bond Authority.  The states have been given expanded tax-exempt bond issuance authority thru 2001 to issue both housing bonds (low-mod income housing developments) and private activity bonds ("PAB's").  PAB's represent a strong financing tool for the development of projects that may not otherwise qualify for the bonus depreciation credit due to the time required for construction (bigger projects).  PAB access in Louisiana is now a mess due to the State Bond Commission's recent decision, so focus on a structured finance solution for projects in Louisiana that uses the BDEA.

  • CDBG.  The states have a total pool of over $11 billion in expanded CDBG funding that can be used for remediation, site clearing, housing development, and/or economic development incentives to bring housing and jobs back to the effected area.  The CDBG funding allocations potentially represent the largest single economic development incentive package ever created for a given region of our country.
